1. INTRODUCTION


1.1. Welcome to  www.talentvision.bg (the "Platform"), which is owned and operated by "Talent Vision" Ltd. and is accessible worldwide.


1.2. By using this Platform, you confirm that you are at least 18 years old and agree to these terms and conditions governing the use of the web Platform. Please read these terms and conditions carefully before using this Platform. If you have any questions, please contact us at contact@talentvision.bg .


1.3. If you do not agree with any of the terms contained in these Terms and Conditions, you must not use this Platform.



2. PURPOSE AND SCOPE OF THE TERMS AND CONDITIONS


These Terms and Conditions are designed to regulate the relationship between "Talent Vision" Ltd., registered in the Commercial Register of the Registry Agency with UIC: 207680355, with headquarters and management address: Sofia, 1404, Triaditsa district, Gotsé Delchev residential complex, Himitliyski Prohod St., Bl. 109, Entrance A, Floor 2, Apt. 4, and email address: contact@talentvision.bg, hereinafter referred to as the "Provider," and users of the Platform who are actors and extras, hereinafter referred to as the "Cast," as well as film industry professionals with a portfolio of at least 3 completed professional projects, hereinafter referred to as the "Crew." Other documents governing the relationships between the Provider, the Cast, and the Crew regarding the use of the Platform include the Privacy Policy and the Cookie Policy.


2.2. These Terms and Conditions come into effect from the moment the Cast or Crew first uses the Platform. The Cast and Crew are required to use the Platform and all of its content lawfully, in accordance with the terms outlined in these Terms and Conditions, and in line with its intended purpose.



3. DEFINITIONS


3.1. For the purposes of these Terms and Conditions:


3.1.1. **Provider** refers to "Talent Vision" Ltd.


3.1.2. **Cast** refers to:

  • An individual who has registered an actor's profile on the Platform, hereinafter referred to as "Actor(s)";
  • An individual who has registered an actor's profile on the Platform but is still a student (has not yet completed higher education) or has recently graduated from a university or academy;
  • An individual who has registered an extra's profile on the Platform, hereinafter referred to as "Extra(s)";

3.1.3. **Crew** refers to:

  • An individual who has registered a profile as a film industry professional on the Platform, such as a Director, Casting Director, Producer, Cinematographer, and/or Composer, hereinafter referred to as "Specialist(s)";
  • An individual who has registered a profile as a film industry professional on the Platform, but is still a student (has not yet completed higher education) or has recently graduated from a university or academy;

3.1.4. **Contact Form** refers to the electronic form provided, the complete filling of which is a condition for establishing contact with the Provider.


3.2. These Terms and Conditions provide information to the Cast and Crew regarding:


  • Identification of the Provider;
  • The subject matter of the Terms and Conditions;

6. SUBJECT MATTER OF THESE TERMS AND CONDITIONS


6.1. The Provider has created the Platform contact@talentvision.bg, which contains detailed information about the services offered by the Provider to the Cast and Crew


6.2. The Provider offers, and the Cast and Crew agree to use, the Platform in accordance with the terms described in these Terms and Conditions.


6.3. In its professional activities, the Provider guarantees the full legal rights of the Cast and Crew as provided by law



7. CHARACTERISTICS OF THE PLATFORM


The Platform contact@talentvision.bg is an online platform designed to unite talents on both sides of the camera. It is created by filmmakers for filmmakers, providing a digital space for individuals in the film industry and facilitating the casting process and the discovery of talent for various roles in film, television, advertising, and theater. By building a profile, actors, extras, students, and recent graduates can showcase their skills, experience, and portfolios, while Crew members—directors, casting directors, producers, cinematographers, and/or composers—can post projects they are working on and share information about themselves. The Platform enables users on both sides of the camera to find their dream job in the film industry.


7.2. The Platform includes comprehensive information regarding:

  • Details about the Provider;
  • Information about each Cast member, presented in a modern portfolio profile;
  • Information about the Crew, presented in their user profile;
  • Details of all projects posted by the Crew through their user profiles on the Platform;
  • Information regarding subscription types and the services they include;
  • Contact details for reaching the Provider;
  • Contact details for reaching Cast members;
  • Contact details for reaching Crew members.

7. Services for Casts and Crews


7.4. Within the Platform, Casts have the ability to use the following services:

  • View the content of the Platform, published announcements, and profiles of other Casts and Crews;
  • Register and manage a user profile;
  • Manage the purchased subscription, including changing the plan, terminating the plan, and modifying the payment method;
  • Add published announcements to the "Favorites" section;
  • Apply for published announcements;
  • Send messages to the Provider;
  • Receive messages from the Provider

7.5. Within the Platform, Crews have the ability to use the following services:

  • View the content of the Platform, published announcements, and profiles of Casts and other Crews;
  • Register a profile for their Crew, specifying up to three professions they are associated with, including Director, Casting Director, Producer, Operator, and Composer;
  • Manage the purchased subscription, including changing the plan, terminating the plan, and modifying the payment method;
  • Publish and manage project announcements;
  • Manage received applications for announcements they have published;
  • Add published profiles of Casts to the "Favorite Artists" section;
  • Send messages to the Provider;
  • Receive messages from the Provider

7.6. The Provider reviews the information submitted by a Cast or Crew, and it becomes visible on the Platform after approval by the Provider



8. Registration


8.1. The Platform interface supports different levels of access, specifically: Cast registration and Crew registration.


For Casts::

8.2. The services offered on the Platform are intended for use by individuals who are of legal age and capable of legal acts and meet the specified requirements for the type of actor profile. Registration of individuals who are minors or legally incapacitated is permitted only in exceptional cases with explicit written consent from a parent, guardian, or custodian, provided that the registration profile or use of the Platform's services does not violate legal provisions and/or public morals. By accepting these Terms and Conditions, the Cast declares that they meet these conditions.


8.3. Registration on the Platform is voluntary and allows the registered Cast to create and manage a portfolio profile to apply for selected project announcements published on the Platform. To complete registration, the Cast must specify one of two types of profiles to continue with the registration procedure and use the Platform's services, namely: Actor profile or Extra profile.


Actor Profile

8.4. For successful registration of an Actor profile, the individual must meet at least one of the following alternative requirements:

  • Be a professional actor with a portfolio of at least 3 (three) completed projects in film, television, advertising, or theater;
  • Be a professional actor who can provide proof of education from a wellknown higher education institution in Bulgaria and/or abroad, or a diploma from such an institution if they do not meet the professional experience required in the previous point;
  • Provide additional information as described in Article 8.6 of these Terms and Conditions if the individual is a student or, although graduated, has limited professional experience compared to the requirements in the previous points.

8.5. To complete registration, the Actor must fill out a registration form providing their name and surname or stage name, email address, and at least one link (electronic connection) to prove the required professional experience. The link should lead to a page containing the name or stage name specified in the registration form.


8.6. If the Actor is a student or, although graduated, has limited professional experience, after selecting the option "I am still a student or recently graduated from a university or academy," the Actor must fill out a registration form providing their name and surname or stage name, email address, and the name of the higher education institution they are attending, including the graduation year or current class, and the name of their primary instructor. Graduated Actors with limited professional experience must attach a PDF copy of their diploma.


8.7. By entering the required information and clicking the "Submit Application" button, the Actor agrees to the Terms of Use and Privacy Policy.


8.8. Within 5 business days of completing the registration form and clicking the "Submit Application" button, the Actor will receive an email from the Provider at the email address provided in the registration form, regarding the approval of the application, notification of its rejection, or a request for additional information or correction of the existing data


8.9. The Provider reserves the right to reject an application for an Actor profile or deny access to the services offered on the Platform if the Actor provides or if the Provider suspects that the Actor has provided incomplete, false, or inaccurate information, or if the submitted application does not meet one or more of the requirements specified on the Platform and in these Terms and Conditions.


8.10. In the event of approval by the Provider, the Actor will receive an email containing a link to choose a payment option for the subscription to the Platform.


8.11. Upon successful completion of the registration approval procedure and successful purchase of a monthly or annual subscription, an Actor profile will be created on the Platform, and an electronic service agreement will be concluded. Access to the profile will be through entering an email address and password. The Actor is responsible for maintaining the confidentiality of their password and for all actions performed by them or third parties using the password.


8.12. Registering the same email address for more than one user profile is prohibited.


8.13. The Actor confirms that the information provided during registration is accurate. The Provider is not liable for typographical errors or inaccurately presented information or information presented in a misleading manner. The Actor is obliged to update and correct outdated and inaccurate information within 7 days of its change. The Actor is responsible for all actions performed through the registered profile and must notify the Provider of any suspected or confirmed unauthorized access.


8.14. The Provider reserves the right to deny access to the services offered on the Platform if the Actor provides or if the Provider suspects that the Actor has provided incomplete, false, or inaccurate information. The Provider also reserves the right to close the created user profile if, in the Provider’s judgment or based on information from competent state authorities, illegal activities are being or have been conducted through the registered user profile.


Background Actor Profile

8.15. To complete registration, the Extra must fill out a registration form providing their name and surname or stage name, email address, and password. By entering the required information and clicking the "Next" button, the Extra agrees to the Terms of Use and Privacy Policy. The registration process is completed after payment of a monthly or annual subscription.


8.16. After successfully completing the registration procedure, the Extra will receive an email from the Provider at the email address provided in the registration form, regarding the approval of the application. An Extra profile will be created on the Platform, and an electronic service agreement will be concluded. Access to the profile will be through entering an email address and password. The Extra is responsible for maintaining the confidentiality of their password and for all actions performed by them or third parties using the password.


8.17. Registering the same email address for more than one user profile is prohibited.


8.18. The Extra confirms that the information provided during registration is accurate. The Provider is not liable for typographical errors or inaccurately presented information or information presented in a misleading manner. The Extra is obliged to update and correct outdated and inaccurate information within 7 days of its change. The Extra is responsible for all actions performed through the registered profile and must notify the Provider of any suspected or confirmed unauthorized access.


8.19. The Provider reserves the right to reject a registration request for an Extra profile or deny access to the services offered on the Platform if the Extra provides or if the Provider suspects that the Extra has provided incomplete, false, or inaccurate information. The Provider also reserves the right to close or delete the created user profile if, in the Provider’s judgment or based on information from competent state authorities, illegal activities are being or have been conducted through the registered user profile. By agreeing to these terms, the Cast member grants the Provider and the Platform full rights to use their profile, including photos, video and audio materials, names, as well as the logo of the company or companies they represent or on behalf of which they conduct their professional activities, for promotional purposes of the Platform, free of charge, and without requiring additional consent.


For Crews:

8.20. The services offered on the Platform are intended for use by industry professionals who meet at least one of the following alternative requirements:

  • Have a portfolio of at least 3 completed professional projects in film, television, advertising, or theater;
  • Have and can provide proof of education from a well-known higher education institution in Bulgaria and/or abroad, a diploma from such an institution, or a certificate for completing a course in the field;
  • Provide additional information as described in Article 8.23 of these Terms and Conditions if the individual is a student or, although graduated, has limited professional experience compared to the requirements in the previous points.

8.21. By accepting these Terms and Conditions, the Crew declares that they meet these conditions.


8.22. Registration on the Platform is voluntary and allows the registered Crew to post announcements, information about the projects they produce, access the entire Platform database, and upload and manage portfolios, showreels, project lists, and selected photos within their profile. To complete registration, the Specialist must specify up to three professions they are associated with, including Director, Casting Director, Producer, Operator, and Composer.


8.23. To complete registration, the Specialist must fill out a registration form providing their name and surname or stage name, email address, and at least one link (electronic connection) to prove the required professional experience. The link should lead to a page containing the name or stage name specified in the registration form.


8.24. If the Specialist is a student or, although graduated, has limited professional experience, after selecting the option "I am still a student or recently graduated from a university or academy," the Specialist must fill out a registration form providing their name and surname or stage name, email address, the name of the higher education institution they are attending, including the graduation year or current class, and the name of their primary instructor. Graduated Specialists with limited professional experience must attach a PDF copy of their diploma.


8.25. By entering the required information and clicking the "Submit Application" button, the Crew agrees to the Terms of Use and the Privacy Policy.


8.26. Within 5 business days of completing the registration form and clicking the "Submit Application" button, the Crew will receive an email from the Provider at the email address provided in the registration form. This email will either confirm the approval of the application, notify of its rejection, or request additional information or corrections to the existing data.


8.27. If the Provider approves the submitted application, the email received by the Specialist will contain a link providing the option to select a subscription payment plan for the Platform.


8.28. Upon successful completion of the application approval process and the purchase of a monthly or annual subscription, a Crew profile will be created on the Platform, and an electronic service agreement for the user profile will be executed. Access to the profile is achieved by entering an email address and password. The Crew is responsible for maintaining the confidentiality of their password and for all activities carried out by them or by third parties using the password.


8.29. It is prohibited to register the same email address for more than one user profile.


8.30. The Crew confirms that the information provided during registration is accurate. The Provider is not liable for any typographical errors or for information that is incorrect or misleading. The Crew is obliged to update and correct outdated or inaccurate data within 7 days of such changes. The Crew is responsible for all actions carried out through the registered profile and must notify the Provider of any suspected or confirmed unauthorized access.


8.31. The Provider reserves the right to reject an application for a Specialist profile or deny access to the services offered on the Platform if the Specialist provides, or the Provider suspects the Specialist has provided, incomplete, false, or inaccurate information. The Provider also has the right to close or delete the created user profile if, in its judgment, or based on information from competent authorities, illegal activities are being or have been conducted through the registered user profile. By agreeing to these terms, the Crew member grants the Provider and the Platform full rights to use their profile, including photos, video and audio materials, names, as well as the logo of the company or companies they represent or on behalf of which they conduct their professional activities, for promotional purposes of the Platform, free of charge, and without requiring additional consent.



9.SUBSCRIPTION


9.1. To access and utilize the features of the Platform, registration is required. Registration is deemed successfully completed upon the purchase of a monthly or annual subscription. The subscription constitutes a fee paid by each registered Cast or Crew to use the services and functionalities provided on the Platform. The subscription plan may be for a duration of one month or one year. The price of the subscription plan varies depending on its duration and the level of access on the Platform, namely: registration as an Extra, registration as an Actor, or registration as a Crew.


9.2. Upon payment of the subscription fee, a subscription service contract is established between the Provider and the Crew or between the Provider and the Cast, which includes granting access to the corresponding functionalities of the Platform, specifically:

  • The Extra subscription plan provides the ability to create a user profile without waiting for verification; to present information about the Extra in a personal profile; the ability to upload videos/showreels, audio files, and up to 20 (twenty) professional photos; the ability to import a list of projects and a resume; access to casting calls for extras; and the ability to submit an unlimited number of applications.

  • The Actor subscription plan provides the ability to create an Actor user profile upon approval of the registration form; to present information about the Actor in a personal user profile; the ability to upload videos/showreels, audio files, and up to 20 (twenty) professional photos; the ability to import a list of projects and a resume; access to all actor castings on the Platform; and the ability to submit an unlimited number of applications for available ads on the Platform.

  • The Crew subscription plan provides the ability to create a Crew user profile upon approval of the registration form; to present information about the Crew in a personal user profile; the ability to upload videos/showreels, audio files, and up to 20 (twenty) professional photos; the ability to import a list of projects and a biography; the right to post an unlimited number of ads and receive an unlimited number of applications; access to the entire database, as well as to all functionalities of the Platform.

9.3. The prices of the subscription plans offered on the Platform are listed in Bulgarian Leva. Payment for the chosen subscription plan can only be made online. Upon initial purchase of a subscription plan, the Cast’s or Crew’s credit or debit card is charged immediately for the entire subscription period with the applicable fee at the time of subscription. The Provider reserves the right to change subscription prices at any time.


9.4. By purchasing a subscription plan, the Crew or Cast agrees to the automatic renewal of the plan in accordance with these Terms and Conditions. The subscription plan will automatically renew on the date of the next payment specified on the Platform, unless the Crew or Cast has canceled the subscription before the end of the subscription period.


9.5. Renewal is carried out by charging the current price for the same duration of the same type of subscription plan. Payment is automatically processed through the credit or debit card used for the previous subscription plan. During the active period of the purchased subscription plan, each Cast or Crew has the right to change the payment method specified on the Platform.


9.6. Each Cast or Crew has the right to change their subscription plan at any time, regardless of the subscription period.


9.7. The right to terminate a distance contract for a subscription service can be exercised only once. The Provider is obligated to remove from the Platform the profile and/or ads published by the Cast or Crew that has canceled their subscription within 10 (ten) days.


9.8. The Provider reserves the right at any time during the active subscription period, without notice, to suspend or terminate access to the user profile of a Cast or Crew in the event of disapproved or overdue payment, regardless of the portion of the amount for which the Crew or Cast is in default.



10. REFUND OF PAID AMOUNT


10.1. Payments made for monthly subscriptions, whether initial or renewed, are non-refundable upon termination of the subscription.


10.2. In the event that the Crew or Cast exercises their right to terminate an active annual subscription plan, the Provider is obligated to refund the amount paid for the remaining period, starting from the date of termination.


10.3. If the Crew or Cast exercises their right to terminate an active annual subscription plan within 30 days of its purchase, the paid price for the entire subscription period is refundable.


10.4. Refunds are made to the credit or debit card used to purchase the respective subscription plan unless the Cast or Crew explicitly specifies a different bank account. The Provider is not responsible for incorrectly specified bank account details by the Cast or Crew.


10.5. Refunds are processed by the Provider within 14 (fourteen) days.The Provider will notify the Crew or Cast by email regarding the refund of the paid amount.



11. USER PROFILE


11.1. The registered profile of a Cast or Crew on the Provider's Platform allows the Cast or Crew to add general information to the profile, including: name or pseudonym; fields in which the Cast or Crew specializes; at least one location where the Cast or Crew is situated; profile picture or logo, and a resume in Bulgarian and English. In the "Contacts" field, links to various social channels such as Instagram, Facebook, TikTok, iMDB, etc., as well as an email address and phone number of the Crew or Cast and/or a Representative/agency working with the Crew or Cast can be added. The Cast has the option to specify in their user profile a set of attributes such as actual age, playing age, gender, citizenship, description of playing appearance, body measurements, all information related to academic education in theater, screen acting, and/or additional training, as well as their skills. The uploaded information becomes visible on the Platform immediately after pressing the "Save" button


11.2. In the "Multimedia" field, up to 10 photos, up to three video material links, up to three audio material links, and a resume in PDF format can be added. Media files uploaded by the Cast or Crew in their personal user profile are reflected on the Platform after content approval by the Provider. The Provider is obligated to review uploaded media files within 5 (five) business days and to send an email regarding their approval or reasons for rejection. Approved media files become visible on the Platform upon completion of the review by the Provider.

11.3. By uploading information to their personal profile, the Cast or Crew guarantees that they have the right to submit the provided content, that it belongs to them, and/or that it will not infringe on third-party rights. The Provider ensures access to the Platform for information provided by the Cast or Crew but does not bear responsibility for the content, accuracy, or correctness of such information.


11.4. The Provider is obligated to contact the Cast or Crew if additional verification is needed regarding the identity of the Cast or Crew, or the content of the information provided in the personal profile. The Cast and Crew are obligated to provide any requested additional information.


11.5. The Provider has the right to temporarily suspend and/or permanently remove the presentation on the Platform of information uploaded to the personal profile of the Cast or Crew if the latter has provided or if the Provider has doubts that the Cast or Crew has provided false or inaccurate information, or if the Cast or Crew is not authorized to use the presented information.


11.6. In the "Completed Projects" field, the Cast or Crew can provide detailed information about completed projects in which they have participated, such as films, series, advertisements, music videos, theatrical productions. It is necessary to specify the name, category, director, and producer of the project, date, and iMDB link to the project, as well as the role the Cast or Crew played. At the discretion of the Cast or Crew, a project cover may also be added.


11.7. In the "Your Job Offers" section, after clicking the "Create Job Offer" button, the Crew can describe the position they are looking to fill, such as Actor, Extra, Director, Producer, Operator, or Composer. Information must include the project name, category/categories, filming location address, dates and location of filming, and the date by which the project will be active. After providing additional information deemed necessary by the Crew, they must specify the available roles and their types, as well as the candidate requirements: gender, age range, citizenship, characteristics, etc. Depending on whether the role is paid or not, the amount of payment per hour or for the entire period must be specified.


11.8. Within 5 business days after completing the ad submission form and pressing the "Publish Job Offer" button, the Crew will receive an email from the Provider at the email address specified in the registration form, for the purpose of Job Offer approval, notification of rejection, or request for additional information or corrections to the provided data.


11.9. The Provider has the right to reject a request for a Job Offer publication or refuse to publish the Job Offer on the Platform if the Crew has provided or if the Provider has doubts that the Crew has provided incomplete, false, or inaccurate information, or if the described ad does not meet one or more of the requirements specified on the Platform and these Terms and Conditions.


11.10. If the submitted Job Offer is approved, it becomes visible on the Platform from the date of approval.


11.11. All active Job Offers, as well as the applications submitted for them, can be tracked by the Crew in the "Your Job Offers" section. The Provider reserves the right to temporarily suspend or stop the presentation of a Job Offer on the Platform in case of violation and/or suspicion of violation of these Terms and Conditions or in case of unfair behavior and/or suspicion of unfair behavior by the Crew



12. RIGHTS, OBLIGATIONS, AND RESPONSIBILITIES OF THE CREWS AND CASTS


12.1. The Crew or Cast agrees to use the Platform and its functionalities lawfully and in accordance with these Terms and Conditions.


12.2. The Crew or Cast has the right to view the content of the Platform, including the user profiles of all Casts and Crews, as well as advertisements available based on the paid subscription plan.


12.3. The Crew or Cast has the right to contact the Provider of the Platform by filling out a contact form.


12.4. The Crew or Cast is permitted to register only one user profile.

12.5. The Crew or Cast is permitted to post information in their user profile.

12.6. The Crew or Cast may delete their data, as well as any other information provided in their created user profile, at any time.


12.7. The Crew or Cast does not acquire any rights of any kind over the information, data, and media files provided on the Platform.


12.8. The Crew or Cast agrees not to use any personal information provided on the Platform for purposes other than those for which it was provided.


12.9. The Crew or Cast shall not acquire, collect, use, or share information provided on the Platform without the explicit permission of the Provider or unless specified in these Terms and Conditions.


12.10. The Crew or Cast agrees to update the information in their registered profile within 7 days of any change.


12.11. The Crew or Cast is not permitted to post content that infringes on the intellectual property rights of the Provider or third parties.


12.12. The Crew or Cast may not post content in any form (image, link, audio file, text, etc.) that is vulgar, threatening, defamatory, obscene, or contrary to public morals.


12.13. The Crew or Cast may not post content that violates legal provisions.


12.14. The Crew or Cast may not modify, copy, alter, duplicate, and/or create derivative works or adapt any part of the Platform.


12.15. The Crew or Cast may not provide to third parties, in any manner or form, for commercial or non-commercial purposes, any content, information, know-how, or technology that has been partially or wholly extracted from the Platform.


12.16. The Crew or Cast may not post, send, or otherwise distribute computer viruses or similar malicious software.


12.17. The Crew or Cast may not deactivate and/or disrupt the full or partial functionality of the Platform or the services offered on the Platform.


12.18. The Crew or Cast may not generate excessive traffic on the Platform or overload the Platform's traffic.


12.19. The Crew or Cast may not interfere with the operation of networks or servers connected to the services, nor obstruct the provision of services.


12.20. The Crew or Cast may not attempt to gain unauthorized access to any part of the Platform or to servers maintained and owned by the Provider.


12.21. The Crew or Cast agrees to keep the email address/user name and password for accessing their registered profile confidential.


12.22. The Crew or Cast may not share their profile for use by other individuals. The Crew or Cast may not use other individuals' profiles.


12.23. The Crew or Cast agrees to immediately notify the Provider of any unauthorized use of their user name and password.


12.24. The Crew or Cast may not use the Provider’s trademark. The Crew or Cast is responsible for all actions related to the use of the website.


12.25. The Crew or Cast may not send "spam," "junk mail," "chain letters," or any unsolicited commercial communications.


For CREW

12.26. The Crew agrees to provide the most complete information regarding the advertisement posted, as specified in Article 17 of these Terms and Conditions.


12.27. The Crew agrees to respond within 14 (fourteen) working days from the date of submission of an application for a published advertisement on the Platform.


12.28. The Crew agrees to regularly check their administrative panel for new applications in the "Your Advertisements" section.


12.29. The Crew has the right to make changes to the description of a published advertisement on the Platform, as well as the offered compensation, if applicable. Creation and changes to information become visible on the Platform after approval by the Provider, in accordance with Article 17 of these Terms and Conditions.


12.30 The Crew has the right to review and edit only information related to their own user profile and published advertisements on the Platform.


12.31. The Crew has the right to delete a published advertisement, as well as any other information provided in their created user profile at any time.


For CAST

12.32. The Cast has the right to apply for an unlimited number of advertisements published on the Platform.


12.33. The Cast has the right to designate a Representative to perform actions on its behalf and at its expense through the Platform.


12.34. The Representative of the Cast may perform actions through the Platform only with the explicit consent of the Cast. The Representative must provide all necessary documents to the Provider before performing actions through the Platform.


12.35. A minor or underage Cast, whose registration is permitted by the Provider, must obtain valid written consent from a parent, guardian, or custodian for the entire duration of the subscription plan.


12.36. Actions performed by a minor Cast are considered valid upon approval by the Cast's Representative. Valid actions performed from the user profile of a minor Cast are considered to be those performed by their Representative. By accepting these Terms and Conditions, the Cast declares that actions performed from the user profile of a minor or underage Cast are valid.



13. RIGHTS AND OBLIGATIONS OF THE PROVIDER


13.1. The Provider reserves the right to make changes to the Platform at its discretion, without obligation to notify and without liability.


13.2. The Provider reserves the right to update, modify, expand, add, supplement, or remove functionalities on the Platform at any time.


13.3. The Provider reserves the right to remove inactive profiles.


13.4. The Provider reserves the right to temporarily suspend, refuse, or terminate the provision of services in the event of a violation and/or suspicion of a violation of these Terms and Conditions, or in cases of unfair behavior and/or suspicion of unfair behavior by the Crew or Cast.


13.5. The Provider reserves the right to close the registered profile of a Crew or Cast in the following cases:

  • At any time after the termination of the subscription by the Crew or Cast;
  • At any time in the event of delayed payment for a renewed subscription plan by the Crew or Cast;
  • In other cases at the Provider’s discretion after prior notice

13.6. The Provider reserves the right to limit or block the access of a Crew or Cast to their registered profile in the following non-exhaustive cases:


  • When the Crew or Cast acts in violation of these Terms and Conditions;
  • When the Crew or Cast performs actions that harm the reputation of the Platform;
  • When the Crew or Cast performs actions that harm the interests of the Provider;
  • In the event of an attempt or actions that violate the security and functionality of the Platform;
  • In the event of infringement of the Provider's intellectual property rights;
  • Upon receiving an order from a competent state authority.

13.7. The Provider reserves the right to refuse the creation of a new profile for a Crew or Cast with a deleted or blocked profile.


13.8. The Provider reserves the right to refuse the creation of a profile for a Crew or Cast if it does not meet the requirements specified in these Terms and Conditions and/or if, after contacting the Provider, it has not provided the required additional information.


13.9. The Provider reserves the right to monitor any information provided in a user profile registered on the Platform, as well as the content and applications of any published advertisements.


13.10. The Provider reserves the right to manage the categories for profiles and advertisements on the Platform – to create, delete, modify, and arrange the sequence of display in the user interface.


13.11. The Provider reserves the right to manage categories within the description of the user profile – to add, remove, or modify features according to the category


13.12. The Provider reserves the right to add a new domain – to add, remove, or modify a new internet address where the Platform and its functionalities, data, etc., are available.


13.13. The Provider reserves the right to add and remove languages available on the Platform.


13.14. The Provider reserves the right to send messages to Crews and Casts.


13.15. The Provider reserves the right to create, modify, or delete static pages to add informational data.


13.16. The Provider is obligated to assist Crews and Casts in using the provided Platform if necessary


13.17. The Provider is obligated to review and approve registration forms for Actors and Crews. The Provider is obligated to activate the user profile of a Crew and Cast upon successful completion of the registration procedure.


13.18. The Provider is obligated to review and approve any changes to the information presented in a user profile or advertisement published on the Platform, including changes to multimedia files, within 5 (five) working days from the date of the change.


13.19. The Provider is obligated to notify Crews of new applications for advertisements published by them on the Platform.


13.20. In the event that a Crew or Cast has forgotten their password for the registered user profile, the respective Crew or Cast may request a new password to be generated. After the request for a new password, the Provider is obligated to send a link to the email of the respective Crew or Cast to create a new password.



14. FORCE MAJEURE


The Provider shall not be liable to the Crew or Cast for any full or partial failure to fulfill its obligations if such failure is due to "force majeure." "Force majeure" is defined as an extraordinary event that occurs after the conclusion of the contract, which could not have been anticipated and is beyond the control of the parties, such as: fire, industrial accidents, military actions, natural disasters—storms, heavy rainfall, floods, hail, earthquakes, ice, drought, landslides, and other natural phenomena; embargoes, governmental prohibitions, strikes, riots, civil disturbances, and others


14.2. In the event that the Provider is unable to fulfill its obligations due to a force majeure event, the Provider is obliged to notify the Crew or Cast in writing within 10 days of the occurrence of such event, as well as the expected duration and cessation of the force majeure circumstance.



15. PROCESSING OF PERSONAL DATA


15.1. The Provider collects and processes personal data of the Crew or Cast in compliance with all standards for data protection according to Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. The Provider respects the privacy of the Crew or Cast and makes every effort to protect their personal data against unlawful processing through the application of technical and organizational measures for data protection, which measures are fully compliant with modern technological advancements and ensure a level of protection appropriate to the risks associated with processing and the nature of the data to be protected. Detailed information regarding the types of personal data processed by the Provider, the purposes of processing personal data, the retention period of personal data, and other information required under Article 13 of Regulation (EU) 2016/679 is available in the Privacy Policy published on the Provider's website.



16. DISCLAIMER OF LIABILITY


16.1. The Provider is not a party to the contract between the Crew or Cast, has no control over any element of the contract, and is not liable to any party in connection with projects carried out through the Platform.


16.2. The Provider makes no warranties that the Platform and the services offered therein will be available at all times and from any location worldwide. The Provider does not guarantee that the Platform will remain unchanged and will be maintained indefinitely.


16.3. The information on the Platform may contain errors or defects, although the Provider strives to keep the information up-to-date. The Provider makes every effort to ensure uninterrupted access to the Platform for the Crew or Cast. The Provider reserves the right to make changes and improvements to the Platform at any time without notice. The Provider is not liable for any damages or losses incurred by the Crew or Cast as a result of using the Platform and the information on the Platform.


16.4. The responsibility for using the Platform lies entirely with the Crew or Cast, as users of its features. The Provider does not assume responsibility for any damages or adverse consequences related to the use of the Platform, including in cases of material damage to the Crew's or Cast's technical devices.


16.5. The Provider is not responsible for actions or omissions by the Crew towards the Cast or by the Cast towards the Crew. The Provider is not liable for actions performed by the Crew and Cast in violation of these General Terms. The Provider is not liable for damages caused by false, misleading, or inaccurate information provided by the Crew or Cast on the Platform.


16.6. The Provider is not liable for damages resulting from user error, computer viruses, omissions, interruptions, or issues with the system maintaining the integrity and structure of the Platform.


16.7. The Provider does not guarantee that the content published on the Platform will meet the expectations of the Crew or Cast.


16.8. The Provider is not liable if an advertisement published by the Crew is deleted.


16.9. The Provider is not liable if the Cast does not receive a response or approval of their application for an advertisement published on the Platform.


16.10. Media files published on the Platform are intended to provide the Cast and Crew with the most accurate representation of the purpose for which the image, audio file, or link was published. However, discrepancies may exist between the actual characteristics of the person, role, or project and those displayed on the monitor of the Cast or Crew. The Provider disclaims responsibility for the accuracy of the characteristics shown on the monitor and for any changes made by the time they are viewed by the Cast or Crew through the Platform.



17. PUBLISHING RULES ON THE PLATFORM


17.1. Within the Platform, the Cast and Crew are required to publish accurate, current, and reliable information.


17.2. The Crew or Cast must publish data that is their own or for which they are authorized to use.


17.3. All information in the user profile of the Cast or Crew, as well as all advertisements, must be in Bulgarian written in Cyrillic or in English written in Latin script.


17.4. Information in the user profiles of the Crew or Cast, as well as photographic material, should be realistic and in compliance with applicable laws, including respecting the rights of others—intellectual property rights, licensing rights, or other ownership rights, advertising rights, or others.


17.5. Information published on the Platform by the Crew or Cast, whether subject to subsequent approval by the Provider or not, must meet the following requirements:

  • Publishing sensitive personal data is not allowed, except in specified fields and only as required by law or these General Terms
  • Publishing another person's resume, project, audio or video file, or providing false, inaccurate, or incorrect information within the Cast’s user profile is not allowed.
  • Publishing any expressions that promote violence is not allowed.
  • Publishing obscene expressions and insults that may infringe on the rights of third parties is not allowed.
  • Publishing content that may endanger or threaten the physical or emotional well-being of minors is not allowed.
  • Publishing content that violates Bulgarian and European legislation is not allowed.
  • Publishing content that is inconsistent with and violates these General Terms is not allowed.
  • Publishing obscene content or pornographic material is not allowed.
  • Publishing misleading or fraudulent information is not allowed.
  • Publishing links that direct to content that conflicts with and violates these General Terms is not allowed.

17.6. All media files uploaded to the user profile of the Crew or Cast are subject to approval by the Provider and must meet the following requirements:

  • Images must align with the purpose for which they are published on the Platform (profile picture, project cover, advertisement, portfolio, etc.).
  • The face of the Cast must be fully visible in the profile picture
  • The face should be the main focus of the profile picture, avoiding unrelated objects.
  • All photos in the Cast's user profile should closely reflect the actual appearance and features of the person.
  • Lighting/brightness should reflect the Cast's natural appearance.
    • Images must not contain nudity, pornographic, or other obscene or inappropriate content, including where the role the Cast may play or the advertisement published by the Crew involves such content.
  • Product images should be in JPEG (.jpeg/.jpg) or PNG (.png) format.
  • Images should not be blurred and/or pixelated.
  • Images should not be transparent.
  • File size should not exceed 2MB (megabytes).
  • The maximum number of photos a Cast can add to their user profile is 20 (twenty).

17.7. All links uploaded to the user profile of the Crew or Cast are subject to approval by the Provider and must meet the following requirements:

  • All links uploaded to the user profile of the Crew or Cast are subject to approval by the Provider and must meet the following requirements:
    • The link should represent an iMDB link to a project created by the Crew, or in which the Cast has played a specific role. The name of the Cast or Crew should be discoverable on the linked webpage.
    • Link to a social channel such as Instagram, Facebook, TikTok, iMDB, etc., of the Cast or Crew.
    • Link to an audio file created by the Crew or Cast, or in which they participated.
  • The link must not infringe or potentially infringe the rights of third parties.
  • The link must not export, re-export, or allow the downloading of messages or software.
  • The maximum number of links a Cast can add to their user profile is 3 (three).

17.8. Every advertisement published by the Crew must include all necessary requirements for its execution and all information needed for the Cast to make an informed decision about applying.


17.9. The information entered in the advertisement, including the title, must not contain obscene (indecent), offensive, threatening, violent words and expressions, or false or misleading information about the role's characteristics, the description of the desired candidate, the address, location, and date of the project, and the remuneration of the selected candidate, if applicable.



18. CONTENT MODERATION PROCEDURES ON THE PLATFORM


18.1. The Provider is required to provide clear and specific explanations for decisions to refuse registration of a user profile of the Crew or Cast, as well as for moderating content published on its Platform, including data in user profiles, advertisements, media files, and other content.


18.2. In connection with paragraph 1 of this section, the Provider has the right to deactivate access to content, remove content, block the access rights of the content holder, and impose other restrictions deemed appropriate if the Crew or Cast has not complied with one or more of the publishing requirements specified in these General Terms.


18.3. If the Provider has removed or not approved the publication of content or has made another decision regarding the rules set forth in this section, the Provider will inform the content holder by sending an email to the address provided in the registration form.


18.4. The holder of moderated content has the right to challenge the moderation decision made by the Provider by submitting a complaint to the Provider in accordance with the complaint handling procedure.



19. COMPLAINT HANDLING PROCEDURE


19.1. In connection with disputes arising from the previous section, as well as any disputes between the Provider and the Crew and/or between the Provider and the Cast, such disputes will be resolved when the respective Crew or Cast submits a complaint to the Provider (either by mail to the address provided in the Provider's identification above in these Terms and Conditions or via email). The complaint must include the following information:

  • Name, address, and other identification details of the respective Crew or Cast;
  • Description of the request;
  • Signature, date of complaint submission, and email address.

19.2. The complaint must be submitted personally by the Crew or Cast. The Provider will maintain separate registers for complaints submitted by the Crew or Cast.


19.3. The Provider will review the complaint and make a determination within 15 business days. If the request of the Crew or Cast is not satisfied, the Provider will inform them of the reasons. If the dispute with the Crew or Cast regarding a decision made within the Provider's internal complaint handling system cannot be resolved, the Crew or Cast has the right to appeal to an alternative dispute resolution body certified under Paragraph 3 of Article 21 of the Digital Services Act for resolving disputes related to such decisions, including complaints that were not resolved through the internal complaint handling system.



20. REPORTING INCORRECT CREWS OR CASTS:


20.1. The Provider adheres to the highest standards of service for the Crews, Casts, and their interests.


20.2. In connection with paragraph 1 of this section, Crews and Casts have the right to submit a report via the Provider's email for the occurrence of the following situations:

  • The Crew has not specified in the advertisement all requirements imposed on the Cast, which would influence an informed decision regarding the application to the published advertisement;
  • The Crew has specified unrealistic requirements in the advertisement regarding experience, skills, or appearance, which are unrelated to the selection of a candidate for the specified role and may lead to discrimination;
  • The Cast has provided inaccurate and outdated information in their user profile, such as gender, age, education, or additional qualifications, characteristics that alter the ability to fulfill the specified role, etc.;
  • The Crew or Cast have used personal data published on the Platform in a manner that contradicts these Terms and Conditions;
  • Presence of other improper practices by the Cast or Crew.

20.3. In connection with the submitted report, the Provider may decide to ban the profile and terminate the subscription plan of the respective Crew or Cast.



21. RESOLUTION OF DISPUTES BETWEEN CREWS AND CASTS


21.1. The Provider is not responsible for disputes arising between Crews and Casts.


21.2. Crews and Casts are obligated to resolve any disputes between themselves independently.



22. LINKS TO THIRD-PARTY WEBSITES

22.1. The Provider's website contains links to third-party internet pages ("Third-Party Sites"), such as the "Instagram" button and links to the developer of the Provider's website. All third-party sites accessible through this Platform are independent, and the Provider assumes no responsibility for any damages or losses incurred by Crews or Casts as a result of using these sites. The Provider is not responsible for the content of third-party sites, nor for the presence of viruses and/or other harmful components on these sites.



23. INTELLECTUAL PROPERTY RIGHTS. USAGE RESTRICTIONS


23.1. All content on the Platform, including but not limited to, all published texts, computer programs, databases, trademarks, and any information uploaded to the Platform, except for photos provided to the Provider for the purpose of presenting a user profile, project, or advertisement, is the exclusive property of the Provider. Use of the Provider’s trademark without its consent constitutes a violation of the law


23.2. The content of the Provider’s Platform may be used by Crews or Casts only for personal, non-commercial purposes in connection with the proper use of the Platform, worldwide.


23.3. The use of any content on the Platform described in the first paragraph of this provision for commercial purposes, in any form (copying, modifying, downloading, selling, reproducing, distributing, publishing, etc.) is strictly prohibited. Crews and Casts assume all responsibility for any use of the site's content that violates the Provider's rights, and the Provider has the right to full compensation for any damages caused by the Crew or Cast.


23.4. Access to the Platform and the services provided on the Platform should not be construed or interpreted as granting any licenses or intellectual property rights.


23.5. Reproduction of the content of the Platform or any part thereof is only permitted with the written consent of the Provider.


23.6. Extracting information from the resources in the Provider’s Platform database and subsequently creating a personal database by a Crew or Cast in electronic or other form will be considered a violation.


23.7. A Crew or Cast that provides information about themselves, completed projects, job advertisements, and other details in their user profile through the Platform grants the Provider a non-exclusive, royalty-free license to store in computer memory, use, delete, publicly display, and distribute this information on the Internet worldwide.



24. FINAL PROVISIONS


24.1. All communications and notifications between the Provider and the Crew and between the Provider and the Cast will be made in Bulgarian or English and will be considered valid if sent in writing.


24.2. The invalidity of any provision of these Terms and Conditions will not affect the validity of the Terms and Conditions as a whole.


24.3. For all matters not addressed in these Terms and Conditions, the provisions of the applicable legislation will apply


24.4. The Provider reserves the right to update, amend, and supplement these Terms and Conditions at any time in the future. When this occurs, the amended Terms and Conditions will be published on this Platform with a new "Last Updated" date at the top and will be effective from the date of publication. Therefore, it is advisable to periodically review these Terms and Conditions to ensure that you are aware of any changes. Your use of the Platform following the publication of the updated Terms and Conditions will be deemed acceptance of the changes.
